CAMS wins but “disappointed” by court action

Action taken today in the Victorian Supreme Court by Formula 3 Australia (F3A) against CAMS was unsuccessful. (see original story)

F3A had sought an injunction against CAMS, to allow a number of cars deemed as not in compliance with FIA Formula 3 Safety and Technical regulations, to compete in round three of the championship at Oran Park this weekend.

The following statement was released this afternoon by CAMS after it successfully defended the action;

"CAMS greatly regrets that a number of competitors presented Formula 3 vehicles for scrutiny that were not in compliance and consequently were prevented from participating at the meeting. We also regret that
competitors whose cars were in compliance have been disadvantaged", said Colin Osborn, CAMS President.

"CAMS appreciates the frustration of the teams concerned, and the impact this has on the championship, but in the! interests of safety, our members, other stakeholders and the integrity of the Safety and Technical Regulations we find ourselves in a position where any other action could not be justified", Osborn said.

The Technical Regulations for FIA Formula 3 vehicles require that all vehicles be fitted with Fuel Tanks complying with the FIA FT3 standard. This standard places a time limitation of five years on the age of the fuel tanks, after which they may be inspected by the manufacturer of the tanks and re-certified for an additional two years if applicable.

As some Formula 3 cars were made in 1996 they have fuel tanks that have exceeded this time limit. The Formula 3 Association (inc) has made several approaches to CAMS to find a way to avoid the expense of returning the fuel tanks to the UK manufacturer for re-certification.

CAMS has maintained that it could not and would not compromise the safety provisions conta! ined within the FIA Formula 3 Regulations and is not able to modify the those regulations. Nevertheless it has considered each request from the F3 Association (inc) and has been in communication with the manufacturer of the fuel tanks, the vehicle manufacturer and the FIA in an endeavor to accommodate the wishes of the F3 Association (inc) whilst maintaining the integrity of the relevant FIA Safety and Technical
Regulations.

Unfortunately all avenues open to CAMS to assist the cars affected in this regard have been unsuccessful.

CAMS will now look forward to working with the Formula 3 Association to reach a workable longer-term solution to this situation.”
